This Is An Agreement Between Exceed Hosting And All Clients.
Activities Subject to Immediate Suspension/Termination
Any hosting account that is used for Illegal, Abusive or Unethical Activity may be immediately suspended/terminated by Exceed Hosting without warning to you. Any misuse or overuse of the server will result in immediate suspension/termination of an account. Illegal, Abusive or Unethical Activities include, but are not limited to inclusion of or linking to violations of privacy, hacking, botnet related scripts and programs, non approved server scripts, eggdrops, proxies, computer virus, gambling, or promotion of gambling, and any harassing or harmful materials or uses, as determined by Exceed Hosting.
You agree to indemnify and hold Exceed Hosting harmless from any claim resulting from your publications or use of Illegal, Abusive or Unethical materials. Although we will make reasonable efforts to alert you to such activities and allow you an opportunity to cure them within a 6-hour period after discovery, we are not required to give notice before suspending/terminating your use of our services if, in our discretion, your use is or results in Illegal, Abusive or Unethical activities. If a hosting account is terminated/suspended, the regular monthly fees still apply.
Each individual hosting account is allowed 1 main domain name with all additional parked domain names pointing to the main site of the main domain, unless otherwise specified, using addons, or parked domains. Exceed Hosting reserves the right to suspend/cancel/terminate any account at any time for any reason. There will be no tolerance of any abuse of any of our support methods, which will result in immediate suspension.
Public Nature Of The Internet
Please understand that all information submitted on the hosting account shall be considered publicly accessible. Important and private information should be protected/backed up by you. Fused Network is not liable for protection or privacy of electronic mail or other information transferred through the Internet or any other network provider that you may use.
Unsolicited Electronic Mail
You are expressly prohibited from sending unsolicited bulk mail messages ('junk mail' or 'spam'). This includes, but is not limited to, bulk-mailing of commercial advertising, information announcements, and political tracts. In accordance with the CAN-SPAM ACT of 2003 S. 877, such material may only be sent to those who have specifically requested it. Malicious or threatening email is also prohibited. Fused Network reserves the right to immediately suspend or terminate your use of our service if we discover such activity. Further, you agree to indemnify and hold Fused Network harmless from any claim resulting from your use or distribution of electronic mail services through the service provided through this Agreement. Anyone using Fused Network's services for spamming will be immediately subject to a $250 cleanup/network abuse fee.
Service Fees
All payments are due on time, without exception. Any failed charges on an invoice are subject to a $25 service fee. Accounts with any past due invoices are at risk of suspension and late fees. Any account suspended for more than a 30 day period will be terminated, by Exceed Hosting, without backup.
Payment for Service and Products
ExceedHosting.com's parent company is Hostwave.com an information technology company. All payments will be billed by "Hostwave.com". Hostwave uses the following payment processors: 2Checkout.com, Paypal.com.
ExceedHosting will send via email an electronic notice, such as an email, for any payment(s) due on the account. This is considered a notice. ExceedHosting may send a subscriber multiple notices if an account becomes in default. ExceedHosting reserves the right to suspend and or cancel an account if an account has not received the subscription payment.
Third Party Script Assistance
Exceed Hosting retains the right not to assist clients with third party applications. This includes any script uploaded by the client, installed using cPanel, it's scripts library or any installer within. Any assistance, support, or troubleshooting provided by Exceed Hosting for ANY third party script or application will be subject to a $15 service fee.
Shared Hosting Accounts
Shared hosting accounts are intended to be utilized by the original account holder only. Granting access or usage to third parties can result in suspension of the account without refund. This also applies to anyone attempting to resell their allocated space or bandwidth to other users.
Downtime or Halt of Service
ExceedHosting a Hostwave Company can not be held responsible for any downtime or non-response of images, website web pages, scripts, email and database. ExceedHosting will make a diligent effort to reinstate any service offered. ExceedHosting will perform a duty of care and provide service to the customer with reasonable time and support on the matter.
Account Cancellation
In the event you cancel your service, you will be charged in full for the entire month in which you canceled your service. Account cancellations for accounts with a negative balance will be passed on to collections, and all services rendered to the party with the negative balance will be terminated, including, but not limited to, domain registrations. In the event you have elected to prepay, subsequent additional months, Exceed Hosting retains the right to charge you an administrative fee of no less than 10% and deduct the administrative fee from the subsequent, future months' Service Fees before refunding them to you. There is a $250 administrative fee for any illegitimate charge backs placed against Exceed Hosting. Any illegitimate charge backs or threatened illegitimate charge backs are grounds for immediate account cancellation, and the amount passed on to collections.
Refunds
We offer 30 day Money Back Guarantee for all hosting plans, Exceed Hosting will provide absolutely no refunds on services rendered, after your account has been active for 30 days.
Exceed Hosting reserves the right to modify this agreement at any time.
